Overview

A data requestor (i.e. Agency / DR Owner) acts as the Data Controller for onward data-sharing to Non-Government Entities (NGE) / 3rd Parties (3P), and may appoint DataHive as its Implementing Agent to operationalise the onward distribution.

Request Flow

Declaring onward sharing in your data request​

Onward sharing is declared in the Onward Data Sharing section of the data request form, where you specify:

  • Whether the results or data will be provided to any other agency or NGE/3P: No, Other agency, or NGE/3P.
  • For Other agency or NGE/3P, the legal ground for the onward sharing. This is separate from the legal ground for the data sharing between the data provider and your agency.
  • For NGE/3P, whether DataHive should share the data on your behalf.

You can choose whether you want DataHive to share the data for you or whether you want to share the data to the NGE/3P by yourself.

  • Yes, I want DataHive to share the data for me — You appoint DataHive as your implementing agent for onward data sharing to the NGE/3P. Fill up the NGE/3P's email, public key and public IPv4 address / address range so DataHive can provision access, plus a request expiry date.
  • No, I want to share the data myself — your agency distributes the data. No technical details, no NGE/3P access provisioning, and no expiry date needed for this purpose.

Either way, your agency remains responsible for the legal basis of the onward sharing and the Terms of Use imposed on the NGE/3P.

Any data request involving onward sharing to an NGE/3P on PSGA legal ground(s) will be held at Pending Minister Authorisation after the "Pending Datafields Review" stage. No data is released to the NGE/3P while it is in this state until further action from the data request's owner.

As the data request owner, you must submit the "Authorising Agency Declaration" to attest that:

  • the Minister's/Minister's delegate's authorisation was obtained (IM8/Data/Data Access and Distribution Clause 3.6), and
  • Terms of Use were imposed on the NGE through executed contractual clauses (IM8/Data/Data Access and Distribution Clause 3.8).

Data requests involving onward sharing to an Other agency, or to an NGE/3P on non-PSGA legal ground(s), will not be held at this stage.
